PORTRAIT COMMISSION

TERMS & CONDITIONS

• The artist agrees to complete a portrait commission to the specific requirements as confirmed in writing by email between the artist and yourself prior to work commencing on the portrait.
• A 30% booking fee deposit is required prior to work commencing on a Custom Portrait Painting.  The balance of payment is due in full after you have approved the digital proof image of the final artwork emailed to you on completion of your portrait commission.  Digital Paintings will be printed after final payment is received.
• A 100% Satisfaction is Guarantee accompanies all portrait commissions.  On completion of your portrait, a digital ‘proof’ image will be emailed to you for your approval.  I am committed to your satisfaction and if necessary will continue to make amendments to your portrait until you are completely happy.  The first revision is free of charge, and to guarantee your total satisfaction please ensure that you clearly outline all changes that you wish to have made at this stage.  Additional amendments after the first revision are charged at $65 per hour.  In the event that you completely change your mind on the original medium or design/style of the portrait, a design fee will apply for time spent on the portrait.
• To comply with Copyright Laws, you must legally own the Copyright of photographs provided to the artist.  Images taken by a Professional Photographer can only be used if the artist is provided with a written authorization from the Photographer. Any legal disputes relating to photographic copyright arising now or in the future will be your legal responsibility.
• The Artist retains copyright to all art work for internet and print display, publicity and promotional purposes unless otherwise agreed in writing.  Prints of your commissioned portrait will not be made available for public sale without your express permission.
• A discount on the Commission Price may be offered at the Artist’s discretion for reproduction of commissioned artwork that may have potential for the art print market.
• Digital Paintings may be purchased separately as electronic files only or as Prints on canvas or Fine Art Paper.
• Digital Painting Portrait electronic files are available for purchase at a discounted fee in exchange for the artist retaining print rights for public sale.   Exclusive Rights may be purchased for Digital Painting electronic files for an additional fee.
• Digital portrait prints are printed by a professional print laboratory using pigment inks with a 75+ year lifespan on the highest quality Fine Art Papers and American made canvas available in Australia.
• Portrait completion and delivery times will vary according to workload and seasonal demands (and of course drying time for Oil paintings).  If you require the portrait by a specific date such as a birthday or anniversary please confirm that this is possible at the time you commission your portrait.
• While every effort is made to ensure delivery of your finished portrait as soon as possible, Completion and Delivery times are an estimate only and may be affected by situations beyond the artist’s control such as illness or injury.
• Portrait Pricing, Terms and Conditions may be modified without notice.
• Submission of photographs and payment of the 30% deposit signifies your understanding and acceptance of these Terms and Conditions.
